Who we are

These terms govern your use of abundantkindling.com.au, theclockworkcloud.com.au and hugenerd.com.au (the “sites”). The sites are operated by The Clockwork Cloud Pty Ltd (ACN 688 627 143, ABN 34 688 627 143), trading as Abundant Kindling, The Clockwork Cloud and Huge Nerd (“we”, “us”). By using the sites you agree to these terms.

Information on the sites is general

Content on the sites, including articles, examples and descriptions of our services, is general information. It is not advice for your circumstances, and you should not rely on it as if it were. Advice we give under an engagement is governed by the written agreement for that engagement, not by these terms.

Any price shown on the sites is indicative. The price that binds us is the one in a written proposal you accept.

Free resources

We make some material available free, including the AI Governance Pack. You may copy it, adapt it and use it inside your own organisation. You may not sell it, or republish it as your own work or as a product. It is provided as general information and as a starting point; whether it suits your organisation is a judgement for you to make.

Energy bill reviews

If you upload an energy bill, we will send you a short, free review of what the bill shows. The review is general information based only on the bill you gave us. It is not a recommendation to switch retailer or buy any product, and you should not make a financial decision on it alone. There is no obligation to engage us afterwards. How we handle your bill is set out in our Privacy Policy.

Your use of the sites

Please do not misuse the sites: that includes submitting false or automated form entries, attempting to access systems you are not authorised to use, or interfering with how the sites work. We may block access where we see this.

Intellectual property

The content of the sites, including text, graphics, logos and code, belongs to us or our licensors. Apart from the free resources licence above, and viewing or printing pages for your own reference, you may not reproduce it without our written permission.

Links to other sites

The sites link to services we do not control, including Substack, where our articles are published. We are not responsible for their content or their handling of your information.

Liability

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.

Subject to that, and to the extent the law allows:

1. we provide the sites and the free resources and reviews described above without any warranty; and
2. we are not liable for any loss arising from your use of, or reliance on, the sites or anything provided free through them.

Where our liability for a failure to comply with a consumer guarantee cannot be excluded but can be limited, it is limited to supplying the service again or paying the cost of having it supplied again.

Privacy

Our Privacy Policy explains what personal information we collect through the sites and how we handle it.

Changes

We may update these terms. The date at the top shows when they last changed, and continuing to use the sites after a change means you accept the updated terms.

Governing law

These terms are governed by the law of South Australia, and you submit to the non-exclusive jurisdiction of its courts.
